What Is Personal Injury?

Personal injury refers to legal cases in which an individual suffers harm due to an accident or incident caused by another party's negligence or intentional wrongdoing. Cases vary in scope and might include car accidents, slip-and-fall accidents, medical malpractice, or workplace injuries. A personal injury lawyer in Houston is essential to understanding the nuances of legal claims following an accident.

At Webster Vicknair MacLeod, we’ve handled numerous personal injury cases. Our legal team is well-versed in the tricks insurance companies play when you are injured, and we intercede in their misguided actions.

What Are Common Tricks Insurers Use to Deny a Personal Injury Claim?

Insurance companies often use tactics to reduce the value of your claim, such as offering a low-ball settlement. A personal injury lawyer not only protects your rights but also helps in the following key ways:

  • Insurers may question the extent of your injury by reviewing medical records or suggesting pre-existing conditions. Your attorney can consult a medical expert to validate the severity of your injury.
  • Insurers may attempt to shift blame to you to reduce the value of your claim. Your lawyer can question witnesses and engage accident reconstruction experts to establish clear liability.
  • Some insurers intentionally delay processing to frustrate you into accepting a low settlement. Your attorney can intervene to keep the process on track.
  • Insurance companies might misinterpret or manipulate policy language to deny coverage. A lawyer can review your policy and ensure you receive the benefits you're entitled to.
  • Insurers may request recorded statements with leading questions to twist your words. You are not obligated to provide a recorded statement, and your lawyer can handle all communication with the insurer, ensuring your case is not jeopardized by misleading questioning.

By having an experienced personal injury attorney in Houston on your side, you can avoid these tactics and focus on recovering while your lawyer handles the rest.

Omar Chawdhary receives $50,441.57 arbitration award for a young woman that was hit by a car while crossing the street with her mother in Glendale, Arizona. Using the crosswalk, she and her mother were granted the right-of-way and entered the intersection. Without warning, a negligent motorist driving a jeep swung left through the intersection and struck the young woman in the chest.

The force of the impact was great enough to throw the young woman backward off the hood of the car. She suffered a broken wrist and substantial bruising and scarring. In order to recover from her wounds, she needed to be in a cast for 6 weeks and entered rehabilitation therapy sessions for her wrist, which lasted for more than two months. The medical bills were less than $25,000.

Mr. Chawdhary represented the young woman who was struck by the negligent jeep driver, during the arbitration session and also helped her build her argument. We are proud to be able to say that the arbitrator decided that our client should be awarded $50,441.57 in damages, which is more than twice her total medical bills.

Brian Quinn, Deceased; v. Federal Express Corporation

Settled for Confidential Amount

Webster Vicknair MacLeodsettles for a confidential amount for the death of a pilot in a plane crash in Kansas.

Webster Vicknair MacLeodrepresented a widower for the death of her husband after a tragic plane crash. On November 6, 2012, Pilot Brian Quinn took off from the Wichita airport, piloting a 1991 Cessna Caravan turbojet which was equipped with a Pratt & Whitney Canada engine, loaded with Federal Express cargo, heading for Garden City, Kansas.

Shortly after leaving the Wichita airport, the engine failed and quit working altogether, due to the failure and separation of a compressor turbine blade. When the turbine blade failed, it flew out of position, severing an oil line and/or the oil cooler, which caused oil to immediately spray all over the windshield, thereby depriving the pilot of vision out of the window.

Despite having no vision out the windshield of the plane and despite that the engine had completely failed, and could not make it back to the Wichita airport for a landing, Quinn made a perfect blind emergency landing in a nearby wheat field. After Quinn landed the plane but before it came to a full stop, the plane collided into a row of trees which Quinn could not see due to the oil on the windshield, and Quinn was killed.

There were several parties in this lawsuit and all but Federal Express either settled or were let out of the case. On the eve of trial, Federal Express settled with Webster Vicknair MacLeodand Mr. Quinn’s family for a confidential settlement amount. Cause number DC-13-13215; Gay Ann Quinn, on behalf of herself and as Administrator/Special Administrator of the estate of Brian Quinn, Deceased; v. Federal Express Corporation, Et. Al.; In the 134th Judicial District Court of Dallas County, Texas

Understanding the Statute of Limitations in Texas for Personal Injury Claims

In Texas, the statute of limitations for filing a personal injury claim is two years from the date of the accident or injury. This legal time limit is important for victims seeking compensation since failing to file within this deadline can result in losing the right to file a lawsuit.

The statute of limitations rule has some exceptions, such as in cases involving minors or when the injury is not immediately apparent. Minors in Texas must be 18 to file a lawsuit. A parent or guardian can file for them; however, the statute of limitation does not start running until the injured individual is 18, and an additional two years is added.

Don’t delay in filing your claim. Evidence can disappear, and witnesses can move or forget. This deterioration of evidence can be harmful to your case. Contact our personal injury attorneys in Houston today to protect your rights and secure the compensation you need to get on with your life.

Recovering Compensation for Your Personal Injury Claim

In a personal injury claim, the court awards several damages to compensate the victim for losses. These include economic, non-economic, and, in some cases, punitive damages. Economic damages are tangible and quantifiable losses, such as the following:

  • Medical expenses
  • Lost wages
  • Property damage
  • Future economic losses

Non-economic damages are more subjective and include the following:

  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life

When egregious actions are involved, the injury victim may obtain punitive damages. This type of award punishes the wrongdoer and prevents future occurrences.

Standing Up to Insurance Companies

It is no secret that insurance companies are often difficult to deal with. They are not on the accident victim’s side and will lobby for the lowest settlement possible. At our firm, we believe this is simply unacceptable. We have extensive litigation experience and are not intimidated by pushy insurance companies; instead, we push right back for the justice our clients rightfully deserve. We can also assist with employment matters regarding the Fair Labor Standards Act and insurance claims involving storm/hail damage.
